not really surprising anyone is it? i don't think there was ever that much of a chance that it would happen...
one court pawns itoff o another, then another....just a waste of money is all it is imho...

The longer Gates can litigate this, the more $ he and M$ can make. All he has to do now is correct (or hide) the M$ business practices that started this (and were upheld by the appeals court when they OK'd the findings of fact in the case). If M$ can go back to court and say "we've seen the error of our ways, and we've already stopped doing these things", they'll probably be substantially off the hook. And if M$ can bring this to a close, future cases will have to "start over" (haven't we been here before?).

Gates had this beat when M$ drew Penfield-Jackson as judge. The reason the Justice Dept. wanted to go to a direct ruling from the U.S. Supreme Court had to do with the fact that P. J. gets overturned regularly at the Appellate level. (IMHO he's not exactly the the most skilled jurist around ) If justice could have won at the Supremes, no further appeals would have been possible. Gates, M$ and their lawyers were smart enough to figure this out (and probably figured out how much money every day of delay was worth), and refused to waive their right to the "full process" of appeals. Now they've gotten the breakup overturned and a new judge. How much do you want to bet the M$ lawyers'll be "working" on those facts next? And in the meantime we get treated to more of the M$ quality and prices we've all come to know & love... :eek:

Big Daddy gates has got the Government in his pocket. I work for the AF and they won't let us touch anything but M$ products.

They get huge kickbacks from M$ too. They wouldn't want to bite the hand that feeds eh?

I'll state again that if you don't like MS products, use someone else's products. I wish I had that choice with electricity, natural gas, local phone service, etc. If your employer has dictated that you must use a certain type of software, your issue lies with your employer and not with the software maker.

I'm not trying to start a religious war or say that MS software is any better or worse than other people's software. That's not the issue here.

Oddly enough, M$ doesn't do the lobbying/contribution thing at the national level. Bill & Co. do lots of philanthropic stuff, though...

Your point is well taken. When it comes to my hard-earned "bones", I buy what my needs warrant and not what anyones marketing effort is hyping. I'm a firm believer in "voting with my wallet'. And no offence taken: If I can't express an opinion AND listen to other peoples ideas without getting rude, well, that'd make me an IDIOT (or at least more of one than usual ). It's a pleasure to talk with people like you. That's why I spend so much time on these boards!

Just to clarify what I wrote earlier; I have a bit of an issue with people and companies who use deep pockets to bludgeon their way through the courts. M$ products are pretty pervasive, so what they do is bound to have an effect on the IT world. Sometimes I think the M$/end-user relationship is like a rhinoceros sharing a bed with a bunch of mice. Even when the rhino is as careful as possible, the mice get bounced around a lot. Sometimes the mice squeek about the situation...when the rhino starts getting too callous. :eek:

just my $0.02

BTW I use M$ as shorthand for Microsoft because it's quick, and most everyone makes the connection...and maybe to "stir the pot" a little

I'm sure that with Linux out there now it helped out MS quite a bit. Gates delayed the whole process enough for another OS to come out. I wouldn't be suprised is he tossed some money to companies like Red Hat to get the ball rolling. Not to long ago, Intel had a similar problem, they delayed and delayed and before you knew it AMD was out and the case was thrown out because Intel no longer cornered the market.

Now let's just hope the stock market stabalizes! I want to retire!
